Terms of Service

1. Parties and Definitions

These Terms of Service ("Terms") constitute a legally binding agreement between ScanEx ("Company", "we", "developer") and the individual ("User", "you") who uses the ScanEx mobile application ("App"). ("Şirket", "biz", "geliştirici") ile ScanEx mobil uygulamasını ("Uygulama") kullanan gerçek kişi ("Kullanıcı", "siz") arasında akdedilen yasal bağlayıcı bir sözleşme niteliğini taşır.

2. Licence and Right of Use

ScanEx grants the User a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence under these Terms. Under this licence: bir lisans tanımaktadır. Bu lisans kapsamında:

• You may use the App on your own device for personal or professional purposes.
• You may not redistribute the App on a commercial scale.
• You may not transfer the App to another device or to third parties.
• You may not attempt to access the App's source code, reverse engineer it, or create derivative software.

Any breach of any provision of the Terms will automatically terminate this licence without notice from us.

3. User Obligations

The User agrees and undertakes to fulfil the following obligations when using the App:

• To use the App solely for lawful purposes and in accordance with these Terms,
• Not to process personal data, identity documents, or confidential documents belonging to third parties without the explicit written consent of the individuals concerned,
• To refrain from any action that would jeopardise the security, integrity, or accessibility of the App,
• Not to attempt to gain unauthorised access to the App or to misuse its APIs,
• Not to use the App through automated tools, bots, or scripts,
• Not to spread viruses, malware, or harmful code through or via the App.

4. Prohibited Uses

The following actions are strictly prohibited and violation of this prohibition may result in account termination, subscription cancellation, and initiation of relevant legal proceedings:

• Creating fraudulent identity documents, certificates, or official papers, or falsifying existing documents,
• Unlawfully processing or distributing documents belonging to third parties,
• Using the App for the purpose of commercial-scale rental, licensing, or resale,
• Seeking security vulnerabilities in the App or conducting penetration testing (unless prior written approval has been obtained),
• Creating spam, phishing, or misleading content,
• Processing content that infringes copyright, trademarks, or other intellectual property rights,
• Disrupting the operation of App infrastructure through excessive API requests.

5. Paid Features and Subscription

ScanEx provides core document scanning and PDF processing functions free of charge. Advanced features such as AI OCR, AI Assistant, Document Translation, and Audio Transcription require an optional paid subscription.

5.1 Subscription Terms

• Subscriptions are offered and managed through Apple App Store or Google Play Store.
• The applicable fee is clearly displayed on the purchase screen prior to confirmation.
• Subscriptions renew automatically at the end of the selected period (monthly or annual); the renewal fee is charged unless cancelled at least 24 (twenty-four) hours before the end of the current period.; mevcut dönem sona ermeden en az 24 (yirmi dört) saat önce iptal edilmediği sürece yenileme ücreti tahsil edilir.
• After purchase confirmation, unused portions of the current period are non-refundable; mandatory statutory refund rights are excluded from this provision.

5.2 Free Trial Period

Free trial periods may be offered from time to time. If you do not cancel before the trial period ends, the paid subscription starts automatically without any additional notification.

6. Cancellation and Refund Policy

6.1 Cancellation

You may cancel your subscription at any time through the relevant app store:

Cancellation takes effect at the end of the current billing period; you retain uninterrupted access to all premium features until the cancellation date.

6.2 Refunds

Since all purchases are made through Apple App Store or Google Play Store, refund requests are subject to those platforms' policies. ScanEx does not have the authority to process refunds independently on behalf of those platforms.

7. Intellectual Property Rights

The ScanEx application, its logo, design, source code, and original content (excluding documents generated by users) belong to ScanEx under all applicable copyright, trademark, and intellectual property laws, and these rights are reserved by us.

Documents created by the User (scanned documents, OCR outputs, PDF files) belong exclusively to the User. ScanEx makes no claim of licence, right of use, or ownership over such content.

Unauthorised use of the "ScanEx" trademark and logo may give rise to legal liability under Turkish and international trademark law.

8. Service Availability and Changes

Since AI-powered features depend on third-party APIs (Anthropic), technical outages in those services may temporarily affect the relevant functions. Core scanning and PDF features work offline and are not affected by such outages.

We may update, modify, or remove certain features of the App without prior notice. We endeavour to provide reasonable advance notice for changes that significantly affect the user experience, but we do not assume any definitive obligation in this regard.

9. Disclaimer and Limitation of Warranty

The App is provided to the maximum extent permitted by applicable law on an "as-is" and "as-available" basis. • That the App will operate without interruption, error, or security incident,
• That AI OCR, document translation, or audio transcription results will be complete and accurate,
• Damages arising from device failure, data loss, or user errors,
• The continuity or reliability of third-party services (Anthropic, Google AdMob, RevenueCat, etc.).

ScanEx's total liability arising from any single incident shall not exceed the subscription fees you paid in the 12 (twelve) months preceding the relevant incident under any circumstances.

10. User Content and Liability

The User represents, warrants, and undertakes that they have the legal right to use, process, and share all documents processed through the App. All legal liability, administrative sanctions, and material/moral damages arising from the processing of third-party documents without consent belong exclusively to the User; ScanEx cannot under any circumstances be held liable for damages arising from such processing.

11. Modification of Terms

ScanEx reserves the right to update these Terms from time to time in line with legal requirements or product developments. In the event of significant changes, users will be notified via in-app notification a reasonable period before the changes take effect. Your continued use of the App after notification constitutes acceptance of the updated Terms. The current version of the Terms is always published at scanex.online/terms. adresinde yayımlanır.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Turkey and all provisions shall be interpreted and applied within the framework of Turkish Law. The courts of the Republic of Turkey have exclusive jurisdiction over all disputes arising from or in connection with these Terms.

However, mandatory consumer protection provisions are reserved for users residing as consumers in a country that is a member of the European Union.

13. Severability and Entire Agreement

If any provision of these Terms is found invalid, unlawful, or unenforceable by a competent court, that provision shall be reformed in the manner closest to the parties' intent and valid; the remaining provisions of the Terms shall continue in full force and effect.

These Terms and the Privacy Policy together constitute the entire agreement between ScanEx and the User regarding their relationship and supersede all prior oral or written agreements and representations.
